GENERAL TERMS AND CONDITIONS

2. PURPOSE AND SCOPE

These General Terms and Conditions govern the commercial relationship between Vadever Solutions S.L. (hereinafter "OpticAtHome") and users who make purchases through the website www.opticathome.com.

By placing an order, the user declares that they:

  • Are over 18 years of age or have the authorisation of their legal representative
  • Have read and accepted these General Terms and Conditions
  • Have provided details that are truthful and up to date

3. PURCHASE PROCESS

The purchase process consists of the following steps:

  1. Selecting products and adding them to the basket
  2. Reviewing the shopping basket
  3. Identifying the user (registration or log-in)
  4. Selecting the delivery address
  5. Selecting the payment method
  6. Confirming and paying for the order

The contract is formed at the moment OpticAtHome sends the order confirmation by email.

4. PRICES AND PAYMENT METHODS

All prices shown on the website include the applicable VAT. Shipping costs are stated before the purchase is completed.

Accepted payment methods:

  • Credit/debit card (Visa, Mastercard)
  • PayPal
  • Bank transfer

All transactions are processed through secure payment gateways with SSL encryption and PCI-DSS compliance.

5. SHIPPING AND DELIVERY

Delivery times:

  • Sunglasses (non-prescription): 24-48 working hours
  • Prescription glasses: 5-9 working days
  • Contact lenses: 24-48 working hours

Shipping costs: Free for orders over €89 in mainland Spain.

Delivery areas: Spain (including the Balearic Islands, the Canary Islands, Ceuta and Melilla), Portugal, France, Italy, Germany, Austria, Belgium and the United Kingdom. Shipments to the Canary Islands, Ceuta and Melilla may be subject to customs procedures.

6. RIGHT OF WITHDRAWAL

In accordance with article 71 of Spanish Royal Legislative Decree 1/2007 (TRLGDCU) and Directive 2011/83/EU, the user has 14 calendar days from receipt of the product to exercise their right of withdrawal without having to give a reason.

To exercise this right:

  1. Notify us of your decision by email to info@opticathome.com or by post to our registered office
  2. Return the product in its original packaging, unused and with all its accessories


Exceptions to the right of withdrawal (art. 103 TRLGDCU):

  • Prescription glasses made to the consumer's specifications
  • Contact lenses whose seal has been opened

Refund: Within a maximum of 14 days from notification of withdrawal, using the same means of payment used for the purchase.

Return costs: Payable by the customer.

7. COMMERCIAL RETURNS POLICY

In addition to the statutory right of withdrawal, OpticAtHome offers an extended period of 30 days for returns, subject to the following conditions:

  • The product must be unused and in its original packaging
  • It must include all accessories and documentation
  • It does not apply to personalised products or opened contact lenses

8. LEGAL GUARANTEE

In accordance with Spanish Royal Decree-Law 7/2021 and Directive 2019/771, all new products carry a legal guarantee of 3 years from delivery.

Important:

  • The seller (OpticAtHome) is liable to the consumer for any lack of conformity of the product
  • The consumer has 2 months from becoming aware of the defect to report it
  • During the first 2 years, the defect is presumed to have existed at the time of delivery

Available remedies:

  1. Repair or replacement of the product
  2. Price reduction
  3. Termination of the contract (if the defect is substantial)

9. COMPLAINTS AND DISPUTE RESOLUTION

Internal procedure: For any complaint, please contact our customer service team at info@opticathome.com or by calling +34 91 467 48 17.

ODR platform: The European Commission provides an online dispute resolution platform available at: https://ec.europa.eu/consumers/odr

Consumer arbitration: Vadever Solutions S.L. is a member of the Spanish Consumer Arbitration System. Users may request dispute resolution through the Consumer Arbitration Boards.

Jurisdiction: For consumer users, the competent courts shall be those of the consumer's place of residence (art. 90.2 TRLGDCU).

  • Managing orders and deliveries: legal basis: performance of the contract (art. 6.1.b GDPR)
  • Customer service: legal basis: performance of the contract and legitimate interest (art. 6.1.b and f GDPR)
  • Sending commercial communications: legal basis: consent (art. 6.1.a GDPR)
  • Compliance with legal obligations: legal basis: legal obligation (art. 6.1.c GDPR)

10.3. Recipients

Your data may be disclosed to:

  • Transport companies, for delivery of the order
  • Payment gateways, to process transactions
  • Public authorities, in compliance with legal obligations

10.4. Retention period

Data will be kept for the duration of the commercial relationship and, thereafter, for the periods legally established to address any possible liabilities.

10.5. Rights of the data subject

You may exercise your rights of access, rectification, erasure, restriction, portability and objection by writing to info@opticathome.com or to our postal address. You also have the right to lodge a complaint with the Spanish Data Protection Agency (www.aepd.es).

11. INTELLECTUAL AND INDUSTRIAL PROPERTY

All content on the website (texts, images, logos, design, source code) is the property of Vadever Solutions S.L. or of its legitimate owners, and is protected by intellectual and industrial property law.

The brands of the products sold belong to their respective owners and are used for information purposes only.

12. FINAL PROVISIONS

Applicable law: These General Terms and Conditions are governed by Spanish law.

Partial invalidity: If any clause is declared void, the remaining clauses shall retain their validity and effect.

Amendments: OpticAtHome reserves the right to amend these terms, giving notice through the website. Amendments will not affect orders already confirmed.

Force majeure: OpticAtHome shall not be liable for failure to meet its obligations where this is due to events of force majeure beyond its control.
